Liability Disclaimer & Limitation of Liability

1. No Guarantee of Results

Tradesite designs and builds websites and provides lead-generation support. Past results shown on this Site (including specific percentages, booking increases, or case studies) reflect individual client outcomes and are not guarantees of future performance. Website performance, lead volume, search rankings, and booking conversions depend on many factors outside our control, including market conditions, competition, ad spend, seasonality, and how a client operates their business. Individual results will vary, and no specific outcome is promised as part of any engagement.

2. "As Is" Services

The Site and Services are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site or Services will be uninterrupted, error-free, or completely secure.

3. Limitation of Liability

To the fullest extent permitted by law, Tradesite and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or lost business opportunities — arising out of or related to your use of the Site or Services, even if advised of the possibility of such damages.

Where liability cannot be fully excluded under applicable law, Tradesite's total aggregate liability arising from or related to the Services shall not exceed the total amount paid by the client to Tradesite in the six (6) months preceding the claim.

4. Third-Party Tools and Content

The Services may incorporate third-party platforms (e.g., hosting, analytics, advertising, or CRM tools). Tradesite is not responsible for the availability, performance, or practices of third-party providers.

5. Indemnification

You agree to indemnify and hold harmless Tradesite from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these terms, or content you provide to us for use on a website we build or manage.

6. Intellectual Property

Unless otherwise agreed in writing, Tradesite retains ownership of proprietary tools, templates, and processes used to deliver the Services. Client-owned content (logos, business information, photos) remains the property of the client.

7. Governing Law

This Disclaimer and any disputes arising from use of the Site or Services shall be governed by the laws of the State of [Insert State], without regard to conflict-of-law principles.
